I was involved in a hit and run truck accident. How do I go about recovering these damages?
Question: Duringa terrible rain storm, my family and I were traveling down the Interstate, trying to get to our motel for the night. Just as we were trying to take theexit to our motel, a truck driver came barreling across the freeway from theother direction and hit us head on. My youngest child in the back seat wasseriously injured and now has serious speech problems. The guy in the movingvan just kept right on driving after he hit us. Who should I contact first? Idid see the moving company’s logo on the side of the van.
Response: Hopefully, you have obtained all of the necessary medical care required by each member ofyour family. If so, you need to immediately seek out a personally injuryattorney who specializes in major trucking accidents and is familiar withpursing brain injury claims.
Since the van driver is guilty of a hit-and-run accident, heor she may face criminal charges in addition to being ticketed for theaccident. It’s always possible that alcohol or drugs were involved when adriver crosses a freeway median or veers into oncoming traffic. That issue mustalso be researched.
Truck laws can vary a bit from state to state so you’ll needyour attorney to carefully research those for you. However, fairly standardpenalties apply to those who are hit-and-run drivers.
